These conditions of sale apply to all sales made in store and on the aucoton.com website.

Prices and currencies

All prices displayed are in Canadian dollars (CAD$) and all charges are processed in Canadian dollars. All prices displayed on this site are subject to confirmation. You agree to pay all charges payable in connection with your order, including applicable taxes and shipping charges, in a single payment at the time of ordering.

Taxes and customs duties

For orders delivered to Canada, we collect the taxes in force, depending on the province of delivery.

For orders delivered to the United States, Europe or elsewhere in the world, we are unfortunately unable to estimate customs duties and taxes. You are therefore entirely responsible for all taxes, duties and customs fees that the transaction on the Canadian site aucoton.com generates.

For security and fraud prevention purposes, online credit card purchases placed through this website will only be accepted if the billing name and address match the name on the purchaser's credit card and the address on file for the purchaser's credit card. If the information does not match, your order will be declined, even if the transaction was authorized by your bank. In this case, we will contact you to obtain the necessary information to be able to credit you using the original online payment method. The information obtained will be kept confidential. Shipping costs

Shipping costs cover preparation and packaging costs, plus postage. They are established according to the delivery method chosen by the customer when ordering, the delivery address, the number of items ordered and the total amount of the order, before taxes (where applicable). Please refer to the shipping costs indicated in the Shipping and Delivery section. These costs may be modified at any time by Original Au Coton, without notice.

Free shipping offers advertised on the Original Au Coton website or in Original Au Coton promotional emails do not apply to orders shipped to Nunavut, Yukon, Northwest Territories, any other remote areas or where Canadian postal codes are accessible by air only. They also do not apply to orders shipped to the United States, Europe or anywhere else in the world.

Processing and delivery times

At Original Au Coton, we make reasonable and necessary efforts to deliver items as quickly as possible and within the stated timeframes. However, we are not responsible for delayed deliveries due to reasons beyond our control. We endeavour to notify users if delivery is to be delayed. All items are delivered by a third party and delivery is subject to the conditions stipulated in their shipping contract.

Online orders are ready to ship within 3-5 business days.

For deliveries within Canada , the delivery time is 2 to 7 business days for Standard delivery and 1 to 2 business days for Express delivery. However, please allow up to fifteen (15) business days for delivery to remote locations.

For international deliveries , the delivery time is 10 to 20 working days. This time could be longer for delivery to remote locations.

Responsibility for shipments

All items purchased through the aucoton.com website are subject to a shipment contract, which means that Original Au Coton assumes the risk of loss of the items ordered as soon as we deliver them to the carrier. Title to these items passes to you when you take possession of the package at the destination, either at the delivery address provided when ordering online or at the postal service drop-off counter, whichever is the earlier.

Postal Returns in Canada : Original Au Coton assumes the risk of loss of returned items as soon as you hand the package over to Canada Post in accordance with the instructions outlined in the Exchange and Return section. Title to these items then transfers to Original Au Coton when Canada Post takes possession of the package.

In the event that the guidelines described in the Exchange and Return section are not followed, you will then assume the risk of loss until we receive the package and take possession of said merchandise.

Postal Returns Outside Canada : You are fully responsible for items returned to Original Au Coton and assume the risk of loss until we receive the package and take possession of said merchandise. Title to such items passes to Original Au Coton when Original Au Coton takes possession of said merchandise.

Exchange and Return Policy

You have 30 days to make an exchange or obtain a refund .

All shipping costs, including those incurred for returns, are non-refundable.

Refunds will be made using the same method of payment as the original purchase.

Returns or exchanges made in store are free.

Postal returns in Canada : the fixed fee of $9.95 for each return of merchandise is the responsibility of the customer. Returns of orders delivered to Canada are made through Canada Post. The 30-day period is calculated between the time the package is delivered to the customer and the time it is dropped off at a Canada Post counter for return.

Postal returns outside of Canada : all costs (customs duties, taxes, postage and other costs) incurred by each return of merchandise are the responsibility of the customer. Returns of orders delivered outside of Canada are made by regular mail, postage paid and insured. The 30-day period is calculated between the time the package is delivered to the customer and the time it arrives at the Original Au Coton service center.

Original Au Coton is not responsible for packages not received.

Products purchased in store can only be exchanged or refunded in store.

Returns and exchanges are for a value equal to the sale price of the merchandise exchanged or returned, including taxes. Shipping costs are not refunded.

Product Eligibility for Exchange or Refund

All merchandise submitted for return or exchange is inspected. If the merchandise does not meet the following criteria, Original Au Coton reserves the right not to process a return or exchange:

  • The merchandise was purchased in store or delivered within the last 30 days (with proof of delivery confirmation)
  • The goods are suitable for resale
  • The merchandise is in its original packaging with its tags attached.
  • The merchandise is in the same condition as it was at the time of delivery
  • The merchandise is unworn and/or unused
  • The goods have not been washed
  • The goods are undamaged

We do not accept returns or exchanges for the following products:

  • personalized items
  • jewelry intended for body piercing
  • underwear
  • gift cards
  • products sold on sale or marked “final sale”

Guarantees

We warrant that the products will be free from any defects in design, assembly, material, for a period of 30 days following the date of taking possession of the goods.

We will, at our discretion, repair or replace any defective product, free of charge.

To be eligible for this warranty, you must provide us with the defective product and a copy of the original purchase receipt for inspection.

This warranty is null and void if we determine that the item has been misused, modified or altered in any way.

This warranty does not provide protection against normal wear and tear or damage resulting from misuse.

This warranty is the only warranty we make. There are no other warranties, express or implied, including the implied warranty or condition of quality, merchantability or fitness for a particular purpose, and such implied warranties, if any, are limited to the duration of this warranty. In no event will we be liable for any consequential, special, direct or indirect damages, including, but not limited to, loss of business or profits arising from the sale or use of any product, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of implied warranties, or of incidental, consequential or other damages, so the above exclusions and limitations may not apply to you.

Exchange or return of a defective product

If you believe that a product is defective, contact us immediately by email at hello@aucoton.com or by phone at 1-514-383-4800 , giving us details about the product and the problem you have found. We will tell you how to proceed.

If you wish to return defective products, you can follow the return or exchange procedure described in the Exchange and Return section. Upon receipt of the product, we will carefully examine it and inform you by email, within a reasonable time, of our decision whether or not to grant a replacement or refund for the defect complained about. We aim to process the refund or replacement as soon as possible and, in any case, within one (1) month from the date on which we confirmed to you by email that you are entitled to a refund or replacement. In this case, we will replace the product or refund its purchase price, delivery costs and applicable taxes via the payment method used when purchasing the non-compliant product.

Jurisdiction

Use of this website and orders placed through it are subject to the laws and jurisdiction of the courts of the Province of Quebec. The user is required to comply with these laws. Any dispute related to them will be subject to the exclusive jurisdiction of the courts of the Province of Quebec. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
